After months of hearings and comments, the U.S. Copyright Office and Librarian of Congress released their triennial exemptions to the Digital Millennium Copyright Act (DMCA) — and the news is good for those of us who care about innovation, creative expression, and interoperability. All three of EFF's requested exemptions were granted, carving out new legal protections for consumers who modify their cell phones and artists who remix videos.
EFF fights hard for your right to use your devices the way you choose, without constraints from manufacturers that try to tie you to certain networks or applications. And EFF fights hard for fair use, working to discard the awful constraint that held video remixers liable under the DMCA for breaking the digital lock on DVDs even when there was no question that they were only breaking the lock in order to make fair use of the underlying materials!
But, while we're rejoicing in this big step towards protecting rights, there's so much more to be done. Terms of service agreements continue to limit the uses you can make of technology you own. User generated content continues to be a lightning rod for copyright and trademark takedown demands without regard for fair use.
